Information clause related to the processing of personal data

Dear Sir or Madam,

Your data is processed based on the necessity of the processing for purposes resulting from the legitimate interests pursued by the Controller on the basis of Article 6(1)(f) of the GDPR.

  1. The controller of your personal data is Fabryka Elementów Napędowych FENA Sp. z o.o., with its registered office in 41-605 Świętochłowice ul. Emanuela Imieli 47, entered into the Register of Entrepreneurs of the National Court Register under number 000139924, REGON 008174001, NIP (VAT No.) 634-012-80-38, Tel: 32 246 61 65, e-mail: dane.osobowe@fena.pl.
  2. Your personal data collected by FENA Sp. z o.o. will be processed independently by us:
    • for analytical and statistical purposes - the selection of products/services to meet the needs of our customers, the optimisation of sales and after-sales service processes, including complaints, which is our legitimate interest (pursuant to Article 6(1)(f) GDPR);
    • to conduct customer satisfaction surveys and determine the quality of our service, which is our legitimate interest (pursuant to Article 6(1)(f) of the GDPR);
    • to offer the Organisation of which you are a representative our products and services, as well as to customise them to meet your needs, which is our legitimate interest (pursuant to Article 6(1)(f) of the GDPR);
    • for the purpose of complying with legal obligations incumbent on FENA Sp. z o.o. under applicable laws, tax and accounting regulations (pursuant to Article 6(1)(c) GDPR)
  3. The controller processes the following categories of your personal data - basic identification data related to our professional cooperation: name, nature of function, telephone (landline, mobile, fax), address and place of work, gender and e-mail address (Article 14.1.d. GDPR).
  4. We have obtained your personal data directly or from your company as part of a business relationship, civil law contract or other civil law relationship.
  5. Under certain circumstances, your personal data may be shared if this is necessary for the performance of our services. They will be transferred exclusively:
    • to persons authorised by us, our employees and associates who need to access the data to perform their obligations,
    • to bodies authorised to receive your personal data under the provisions of the law,
    • to other data recipients e.g.: couriers, banks, insurance companies, law firms.
  6. We do not transfer your data outside the European Economic Area.
  7. We process your data obtained in connection with the cooperation/collaboration agreement for a maximum period of 10 years from the date of termination of the agreement in connection with the assertion of claims arising from the performance of the agreement or protection against claims by FENA Sp. z o.o. After this period, the data will only be processed to the extent and for the duration required by applicable law.
  8. Your provision of data is voluntary, but essential for the continuation of the cooperation/collaboration agreement.
  9. You have the right of access, rectification, erasure, transfer and restriction of data processing by the controller, as well as the right to lodge a complaint with the President of the Data Protection Authority.
  10. You have the right to object to the processing of your personal data by the controller.
  11. Your data will not be processed by any automated means, nor will it be profiled.
  12. The data Controller shall make every effort to ensure that all physical, technical and organisational measures are implemented to protect personal data against accidental or wilful destruction, accidental loss, alteration, unauthorised disclosure, use or access, in accordance with all applicable regulations.
